The ends of civil justice in the constitutional rule of law

Authors

  • Felipe Valenzuela Quirós

Abstract

The article analyzes the notions about the ends of the Chilean civil process, to then criticize them, holding that they do not satisfy the current mandates of International Fundamental Rights. At the same time, a critique is made to the current chilean civil process, exposing its deficits, to then remark that it maintains nineteenth-century social structures, being the civil process a tool for its prevalence. Finally, a proposal of redefinition of the ends of civil justice is done on the basis of certain cultural and social considerations that underlie the reality of the process.
